IMPORTANT
- Reports can be used in front of the courts as certificates, according to
articles 200 - 202 of the New Code of civil procedure.

constant way by the Court of Cassation, since its principal stop N 1020 of
November 7th, 1962.
- The agents deprived of searches can be indicated by the Courts to make inquiries
(prescription of the Commercial court of Bordeaux of January 27th, 1999).
- The new article 20 of the Law of July 12th, 1983 defines deprived research
agencies as the profession liberale which consists, for a person,
in collecting, even without stating its quality nor revealing the object of
its mission, information or information intended for third parties,with the
aim of the defence of their interests.
LAW
OF MAY 26TH, 2004 DIVORCES
Since May 26th, 2004, the new law on the divorce is promulgated,
it will apply from January 01st, 2005.
It is necessary to know that the divorce for fault corresponds to 42 % of
the procedures, as for the divorce by mutual agreement, it is chosen in 41
% of the cases. The new law maintains four cases of divorce but it modifies
them in the new article 229 of the Civil code, is:
- The mutual assent.
- The acceptance of the principle of the break of the marriage.
- The definitive change of the conjugal link.
- The divorce for fault.
The divorce can be asked in case of "violation grave or renewed by the
duties and the obligations of the marriage by one of the couple" it
is about the new article 242 of the Civil code. There are here no major modifications
with regard to the Law of July 11th, 1975, The Government preserved the divorce
for fault because everything cannot be do.
